Dept. of Environmental Protection Contact: BUREAU OF RESOURCE RECOVERY & TECHNICAL PROGRAMSOUR MISSIONThe mission of the Bureau of Resource Recovery and Technical Programs is to specify design, construction, and operation standards that ensure the environmentally sound operation of the State's resource recovery facilities, incinerators, composting facilities, Class D recycling centers, regulated medical waste facilities, and beneficial use projects. These standards ensure that solid wastes are managed, disposed of and recycled in such manner as to protect public health, preserve the environment, and enhance the quality of life for the citizens of the State of New Jersey. These activities are accomplished under the authority of the "Solid Waste Management Act," N.J.S.A. 13:1E et seq., the "New Jersey Statewide Mandatory Source Separation and Recycling Act," N.J.S.A. 13:1E-99.11 et seq., commitments contained in the Department's Performance Partnership Agreement with the United States Environmental Protection Agency and the Memorandum of Understanding with the New Jersey Department of Health and Senior Services. These goals are pursued by establishing facility design and construction standards and operational performance limits based on the need to protect environmental receptors from the impacts of the facilities by evaluating facility performance to ensure that facility operation is maintained at the level necessary to achieve compliance with the Department's approval and the applicable environmental standards as well as by providing regulatory technical assistance for the solid and hazardous waste, asbestos, and regulated medical waste regulations. Facilities To ensure that the operation and closure of hazardous waste treatment, storage and disposal facilities, solid waste transfer stations, materials recovery and intermodal container facilities, and permit-exempt activities are conducted in accordance with the letter and intent of regulations and in a manner which does not unreasonably endanger human health or the environment. To provide, in a timely manner, clear, correct, and consistent communication to the owners and operators of hazardous and solid waste management units, of the determinations made regarding those units. This is accomplished
through permit application, closure and other approval and compliance evaluation
processes. Process permit and permit modification applications in accordance with the procedures and requirements specified in N.J.A.C. 7:26 and 40 CFR Parts 260-270, the Memorandum of Agreement and Performance Partnership Agreement with the USEPA, the published guidance documents of the Department and the USEPA, and the policies and procedures of the Bureau. Utilize the available technical manuals and guidance documents and technical assistance support groups and the procedures developed through Department process teams to produce timely, complete and thorough information request, comment solicitation and decision documents for the applicant, the Department, the USEPA and the public. Monitor the compliance of hazardous and solid waste facilities with conditions of permits and regulatory requirements through the review of financial document status, facility reports and other submittals, site inspections, and communication with the enforcement program. Prepare written notices of approval or deficiencies, as appropriate, to the facility owner/operator and assistance to the enforcement program as requested. Maintain organized and updated files, computer databases, and status reports, to enable accurate and efficient reporting and information access to the Department, the USEPA, and the general public, and to enable proper work planning and performance evaluation by Bureau and Division. Develop and disseminate to staff, the Department and the regulated community, guidance on the understanding of regulations and various submittal requirements, and provide recommendations for and/or comments on the proposed rule changes, to the Division's regulatory development program, for consistency between the letter and the intent of hazardous and solid waste regulations. |
